Terms of Use

These Terms of Use set out the conditions on which the information and services on our website are made available to you.

1. The parties

1.1. This User Agreement (the "Agreement") is made between the COSMETICS AND CLEANING PRODUCTS MANUFACTURERS ASSOCIATION ("KTSD") — an association founded and existing under the laws of the Republic of Türkiye, with its registered address at Sahrayıcedit Atatürk Cad. Dilkum Sitesi 6 Blok No: 57 Kat:1 D:11, Kadıköy, İstanbul, telephone 216 368 76 84 — and the user of the website at http://www.ktsd.org.tr/login (the "Website" and the "User" respectively). It concerns the User's use of the Website and takes effect the moment the User accepts it in the electronic environment where the Website is hosted.

1.2. By signing in to the Website, the User accepts and declares that they have read the Agreement in full, understood its contents entirely, and approved all of its provisions. (KTSD and the User are referred to individually as a "Party" and together as the "Parties".)

Terms of use, access, risk, limitation of liability, IP addresses

1. The website at http://www.ktsd.org.tr/login and every document on it belong to KTSD. Those documents may not be copied or reproduced except where it is necessary to display them within the online system. Separately from the above, you may print pages of the site for your personal use, and KTSD may make particular documents available for download. Any legal liability arising from use that infringes the intellectual or industrial property rights in the documents on this site rests with the user.

2. KTSD takes such measures as are available to it to keep the website free of viruses and similar software, but final security is the user's own responsibility: the user must provide their own virus protection and maintain it. Accordingly, the user accepts that they are responsible for any errors that may arise in their own software and operating systems as a result of visiting http://www.ktsd.org.tr/login, and for the direct or indirect consequences of those errors.

3. All information, images, descriptions, documents and news on http://www.ktsd.org.tr/login (together, "information") are provided for promotional and informational purposes only. The user may not claim that the information on the website is incorrect, or that they have suffered loss in reliance on it. Where the user intends to act on the information, they accept that they are responsible for obtaining final and reliable information from KTSD, and that KTSD bears no liability for information published on the website ceasing to be current.

4. KTSD reserves the right, at its own discretion, to change the content of the site at any time, to change or discontinue any service provided to users, and to delete user information and data recorded on http://www.ktsd.org.tr/login. While KTSD takes every measure to keep the website free of errors, it gives no warranty in respect of errors that exist or may arise on the site.

5. If a criminal complaint or an official request for investigation is received from the authorities in respect of a user, and/or a user is found to have carried out electronic sabotage or an attack that obstructs the operation of KTSD's systems or alters how they work, KTSD has the right to investigate that user's identity information and to report it to the legal authorities.

Securing the KTSD website, all of its sub-sites and its other information systems is KTSD's responsibility. Scanning for vulnerabilities in websites and other information technology systems — whether for commercial purposes, in good faith, or for any other reason — and exploiting any vulnerabilities found in order to damage the systems, exfiltrate information or similar, is unlawful. Where such activity is carried out, sanctions may be applied under Law no. 5651 on Regulating Broadcasts via the Internet and Combating Crimes Committed through such Broadcasts. In the event of such attempts, KTSD reserves the right to begin legal proceedings using the type of attack, its timing and the data collected about the attacker within the scope of the law, and to seek penalties up to and including fines or imprisonment.

6. In some cases, information that does not identify you personally may be collected. Examples include the type of internet browser you use, your operating system, and the domain name of the site from which you reached us by a link or an advertisement.

7. Matters to be observed under Law no. 5846 on Intellectual and Artistic Works and Law no. 5651 on Regulating Broadcasts via the Internet and Combating Crimes Committed through such Broadcasts:

The user accepts and declares that the website may contain links giving access to other websites or content; that their control, accuracy and adequacy are unconnected with KTSD; that KTSD does not endorse those sites in any way and does not guarantee the accuracy of the information they contain; that KTSD bears no responsibility for the content on them; and that neither KTSD nor any of its affiliated group companies, employees, directors or authorised persons or organisations bears any legal or criminal liability for the use of those sites and/or their content, for the consequences of decisions taken in reliance on that content, or for any material or moral, positive or negative loss or expense suffered because the user did not read the terms of use of the site, or read them and did not act in accordance with them; and that KTSD does not guarantee the accuracy and/or adequacy of the information on the site.

The user accepts and declares that the website may contain writing, information, commentary, opinion, news, imagery, pictures, figures, graphics and other material belonging to KTSD or to a third person or organisation; that KTSD holds the legal rights in that material under the Law on Intellectual and Artistic Works; and that it may not be copied, altered, reproduced, published, sold, licensed or interfered with without KTSD's permission.

All logos, trademarks and corporate emblems published on this site are protected under Decree-Law no. 556 on the Protection of Trademarks. The logos may not be copied or used in any way. The user accepts and declares that neither KTSD nor any group company affiliated with it or to which it is affiliated, nor their employees, directors or authorised persons or organisations, bears any legal or criminal liability arising from the KTSD logo or pages of the website appearing in any form on another website, from the use of information obtained through any content uploaded to the website by third parties or visitors, or from any content which does not give rise to liability within the general practices of internet use.

8. KTSD has the right to change, renew or cancel any provision of these Terms of Use on http://www.ktsd.org.tr/login without notice. Every provision changed, renewed or repealed takes effect for all users on the date it is published.

9. Confidentiality

The documents shared with members under the membership heading of the extranet interface — reachable through the website with a password assigned to the user — including meeting agendas and notes, attendance photographs, presentations, position papers, reports, event photographs, official letters sent to institutions and official letters received by KTSD from institutions, are confidential information and data. The user may use them only for the purpose for which they were provided, and must under no circumstances share them with third persons or companies who are not concerned with that purpose, or disclose them publicly.

10. Final provision

The user irrevocably accepts, declares and undertakes that, before entering the website, they have read the "Terms of Use and Privacy / Personal Data Protection Policy" set out above; that they will comply with all of the matters stated above; and that the content on the website and all of KTSD's electronic media and computer records shall constitute conclusive evidence under Article 193 of the Code of Civil Procedure.
